Pornographic
sites such as Pornhub and others were sued by a deaf man because of lack of
closed captions on the site as he “cannot enjoy video content” without closed captioning.
As per the
lawsuit file in the Eastern District of New York, Yaroslav Suris, a resident of
New York, was trying to watch videos on Pornhub titled “Hot Step Aunt Babysits
Disobedient Nephew,” “Sexy Cop Gets Witness To Talk” but couldn't because there
were no closed captioning.
What Was
in The Lawsuit?
According to
the lawsuit, adult sites such as Youporn, Pornhub, and RedTube are not
following the 1990 Americans with Disabilities Act whose goal is to provide
“full and equal enjoyment” of facilities, services, and privileges meant for
public accommodation.
"Websites
that prevent accessibility to deaf and hard of hearing individuals is a
discriminatory act," the lawsuit states.
ADA Statement
The ADA
quotes that its motto is "to make sure that people with disabilities have
the same rights and opportunities as everyone else."
By
disrespecting the law, they are in a dire position and they are not considering
the necessary demands of their customers. This has led the man to sue the
pornographic website.
Corey
Price Disagrees
While
disputing the claim, Pornhub's vice president Corey Price said that "While
we do not generally comment on active lawsuits, we’d like to take this
opportunity to point out that we do have a closed captions category,".
Not The First
Time Such Case is Filed
This is not
the first time when Suris has been involved in such an incident. He has sued
Fox News, the New York Post, and other outlets in past for the same reason.
The demands
made by Suris include compensatory damages, civil penalties, and fines against
Pornhub.
